DUI Charges for Underage Drivers

When a driver is not of drinking age, he or she cannot operate a motor vehicle with any detectable amount of alcohol in his or her system. This translates to operating a motor vehicle with a blood alcohol concentration (BAC) of .01% or greater. Often referred to as California’s Zero Tolerance Law, this is actually a civil offense. Unlike a typical criminal drunk driving offense, under 21 DUI involving a BAC of .01% or greater may only result in driver’s license suspension and no term of imprisonment.

If an underage driver has a BAC of .05-.07%, however, additional penalties may apply under California Vehicle Code section 23140. If a driver is under the age of 21 and is found to be driving with a BAC of .05-.07%, the following penalties may be imposed:

  • A fine of $100
  • Loss of driver’s license for 1 year
  • Minimum three-month alcohol program

An underage driver found guilty of operating a motor vehicle with a BAC of .08% or greater will face the same penalties as a driver over the age of 21, as this applies to regular DUI charges.
